1. Applicability

1.1 Volorica operates http://www.volorica.com, offering for sale high-quality, previously owned watches.

1.2 Business interactions between Volorica and the customer are governed solely by these Terms and Conditions. Any customer-provided terms that diverge from these Terms are not valid unless Volorica expressly agrees to them in writing.

2. Conclusion of the Purchase Contract

2.1 All offers from Volorica are non-binding and meant for customer consideration.

2.2 Volorica guarantees that all watches listed are authentic, with each description precisely reflecting the product's condition.

2.3 Each product listing may include detailed, high-resolution photos created by Volorica. Photos may have been slightly adjusted for color, brightness, and focus but otherwise remain unaltered.

2.4 Unless otherwise noted, watches are shipped in neutral packaging without original papers or packaging.

2.5 Visible signs of wear shown in the photos are considered as described. Unless specified, all watches have undergone maintenance, repair, and adjustments.

2.6 A customer’s order is an offer to Volorica to purchase a watch. The contract is only valid once Volorica confirms acceptance via email, subject to availability.

2.7 If an ordered watch becomes unavailable, Volorica will notify the customer.

2.8 The acceptance email serves as the official contract confirmation, detailing the order and payment information.

3. Prices and Payment Terms

3.1 Prices are listed in US Dollars, inclusive of any applicable shipping charges shown on the Volorica website. The sale is VAT-exempt under differential taxation, with VAT not itemized on the invoice.

3.2 Any agreed price reductions are valid only with written confirmation.

3.3 Orders are dispatched only after full payment of the purchase price and shipping fees.

3.4 Payment is due within 7 working days of receiving the order confirmation. Bank details will be provided in the confirmation email.

4. Volorica’s Right of Withdrawal Due to Non-Payment

4.1 Volorica reserves the right to withdraw from the contract if payment is not received within the specified period. Partial payments received will be refunded within 30 days.

4.2 Notice of withdrawal will be communicated via email.

5. Shipping, Shipping Costs, and Risk Transfer

5.1 Watches are fully insured and packaged securely, generally shipped via DHL Express or FedEx.

5.2 Customers are responsible for any customs, VAT, or import fees on shipments outside the United States.

5.3 The risk passes to the customer upon handover of the watch to the carrier.

6. Damages During Transport

Customers must report transport damages immediately to the carrier and notify Volorica in writing within 3 days of receiving the shipment.

7. Warranty, Liability, and Damages

7.1 For business customers, the warranty for used merchandise is excluded.

7.2 For consumers, liability for damages is limited, and warranty claims for used products expire after one year.

7.3 Warranty does not cover watch accuracy, water resistance, or typical wear (e.g., scratches or damaged watch parts). Damage from external impact, contamination, or improper handling is also excluded.

7.4 Attempts to repair the watch by the customer or a third party void the warranty.

8. Procurement Risk

Volorica does not assume any procurement risk and may withdraw from a contract if the watch becomes unavailable from suppliers.

9. Set-Off and Right of Retention

9.1 Customers may offset claims only if they are undisputed or legally binding.

9.2 The right of retention applies only if the counterclaim arises from the same contractual relationship.

10. Identification for Transactions Exceeding $15,000

10.1 Identification is required for transactions above $15,000 in compliance with anti-money laundering regulations.

10.2 Individuals must provide a valid photo ID, and legal entities must provide official registration documentation.

11. Privacy

Volorica observes data protection regulations, and personal data will only be collected as necessary for contract execution. Data will not be shared unless essential for fulfilling the contract. Customers may request access to stored personal data.

12. Copyright

12.1 All content on http://www.volorica.com, including text, images, and website layout, is protected by copyright. Any reproduction requires prior written permission.

12.2 Volorica is not affiliated with any watch manufacturer, and all trademarks and designs belong to their respective owners.

13. Governing Law and Jurisdiction

13.1 This agreement is governed by applicable local law, without regard to international sales regulations.

14. Refunds & Returns

14.1 Sales are Final: Returns Only Considered for Immediate and Verified Defects

Due to the unique nature of vintage items and our rigorous servicing process, all sales are considered final. Returns or refunds are only considered in the rare event of a verified serious defect present when the item immediately arrives. In such cases, we will work directly with the customer to resolve the issue. If the watch is returned exactly as sold and our inspection confirms the defect was not caused by the customer, a refund may be issued.

14.2 Responsibility for Returned Packages

Volorica cannot assume responsibility for expenses due to returned packages caused by unclaimed shipments or incorrect addresses provided by the customer. If a package is returned to us, the buyer will be responsible for a re-shipping fee, as the original shipping label will no longer be valid. We will contact the customer to provide a link to repurchase the shipping label. Please note that original shipping and processing fees are non-refundable.

If the customer chooses not to purchase the re-shipping label or refuses the package, a restocking fee of 20% of the total purchase will be applied.

 

14.3 Condition Discrepancies and Expectations:


Please be aware that all items sold by Voloricá are vintage and, as such, are not in brand new condition. While we strive to provide accurate descriptions and clear images, vintage items may exhibit minor signs of wear that are not explicitly detailed. If you believe that the condition of the item significantly deviates from the description provided, please contact us at volorica.collection@gmail.com within 24 hours of receiving your watch. We will review our inspection and packaging videos to assess the condition and accuracy of the item at the time of shipment. This process ensures any serious discrepancies are addressed promptly and fairly.
